Finding the best medical negligence solicitors Glasgow has to offer

When medical treatment goes wrong, the consequences can be life-changing: a missed cancer diagnosis, a surgical error, a birth injury or a loss of a loved one. A medical negligence claim will not undo the harm, but it can pay for care, adaptations and lost income, and it can give families answers. Choosing the right solicitor matters more here than in almost any other area of law, because these claims are complex, expert-driven and fiercely defended.

Medical negligence (also called clinical negligence) is a specialist branch of personal injury law. Claims against NHS Scotland health boards, including NHS Greater Glasgow and Clyde, are defended by the NHS Central Legal Office, so you need a team that instructs the right independent medical experts early and knows how these cases are fought. Scotland also produced the leading UK case on informed consent, Montgomery v Lanarkshire Health Board, decided by the Supreme Court in 2015, which changed how doctors must explain the risks of treatment.

This guide compares eight Glasgow-based teams. Every firm listed has a Glasgow office and is recognised in the independent Chambers UK and Legal 500 rankings for medical negligence claims in Scotland.

Medical Negligence solicitors Glasgow: frequently asked questions

What counts as medical negligence in Scotland?

Medical negligence is treatment that falls below the standard expected of a reasonably competent practitioner and causes you harm. Scottish courts use the test from Hunter v Hanley: a doctor is negligent only if they failed in a way that no doctor of ordinary skill would fail when acting with ordinary care. You must also prove that the failure caused your injury, which is often the hardest part of a claim and is why independent expert evidence is essential.

How long do I have to make a medical negligence claim in Scotland?

The general time limit is three years from the date of the injury or, if later, the date you became aware (or reasonably should have become aware) that the injury was caused by negligence. For children, the three years does not start until their sixteenth birthday, and it does not run while a person lacks capacity. Courts can occasionally allow late claims, but you should never rely on that: speak to a solicitor as early as possible.

What is informed consent and why is Montgomery important?

Before treatment, your doctor must tell you about material risks and reasonable alternatives, meaning anything a reasonable person in your position would want to know. This principle comes from Montgomery v Lanarkshire Health Board, a Scottish case decided by the UK Supreme Court in 2015. If you were not warned about a risk that then happened, and you would have chosen differently if warned, you may have a claim even if the treatment itself was carried out properly.

Can I claim on a no win no fee basis?

Yes. Most medical negligence firms in Scotland offer success fee agreements, often called no win no fee. If you win, the solicitor takes a percentage of your compensation, and for personal injury and medical negligence claims that percentage is capped by law at 20% of the first £100,000, 10% of the next £400,000 and 2.5% of anything above £500,000. Since 2021, qualified one-way costs shifting also means that in most cases you will not have to pay the NHS's legal expenses if you lose.

Should I complain to the NHS first?

You do not have to, but a complaint can produce useful answers and documents. NHS Scotland complaints should usually be made within six months of the event or of finding out about it, and if you are unhappy with the response you can go to the Scottish Public Services Ombudsman. A complaint does not stop the three-year time limit for a legal claim, so take legal advice at the same time.

Who pays compensation in claims against the NHS in Scotland?

Claims against NHS Scotland health boards are handled by the NHS Central Legal Office and paid through the Clinical Negligence and Other Risks Indemnity Scheme (CNORIS), so compensation does not come directly out of a hospital's budget. Claims against private hospitals, dentists or cosmetic clinics are usually met by the provider's insurers.

Can a family claim if someone died because of medical negligence?

Yes. Under the Damages (Scotland) Act 2011, close relatives can claim for the loss of support, funeral costs and the grief and loss of society caused by a death. These claims are sensitive and complex, so choose a firm with specific experience of fatal claims.

How long does a medical negligence claim take?

Most claims take at least one to two years, and complex birth injury or brain injury claims can take considerably longer because the long-term effects need to be understood before the case can be valued. Many claims settle without a court hearing. A good solicitor will seek interim payments where liability is admitted, so you are not left without support while the claim continues.

How do I choose the best medical negligence solicitor in Glasgow?

Look for a dedicated claimant team with Chambers or Legal 500 recognition, ask who will actually run your case and whether they are a ranked or accredited specialist, and ask how the firm is funded and what success fee it charges. The Band 1 firms in this guide (Drummond Miller, Anderson Strathern and Balfour+Manson) are a strong starting point for complex or high-value claims.

Conclusion: choosing your Glasgow medical negligence solicitor
